OVERVIEW

This website is operated by Classy Butterfly LLC (“Classy Butterfly,” “we,” “us,” or “our”). Classy Butterfly provides this website, including its information, content, features, products, services, and tools, to you subject to these Terms of Service (“Terms”).

Our online store is hosted by Shopify, which provides the ecommerce platform that allows us to offer products and services to you.

By visiting our website, making a purchase, creating an account, submitting an inquiry, or otherwise using our website or services, you agree to these Terms and all policies referenced within them. These Terms apply to website visitors, customers, account holders, and anyone else who uses our services.

If you do not agree to these Terms, please do not use the website or purchase our products or services.

SECTION 1 — ELIGIBILITY AND ONLINE STORE USE

By agreeing to these Terms, you represent that you are at least the age of majority in your state or jurisdiction of residence or that you have permission from a parent or legal guardian to use this website.

You may not use our website, products, content, or services for an unlawful, fraudulent, abusive, or unauthorized purpose. You may not transmit viruses, malicious code, or other material that could interfere with the operation or security of the website.

We reserve the right to refuse or discontinue service when reasonably necessary to protect Classy Butterfly, our customers, Shopify, or others from suspected fraud, abuse, unlawful activity, policy violations, or security risks.

SECTION 2 — PRODUCTS AND SERVICES

Classy Butterfly offers ready-made, handmade, customized, personalized, made-to-order, digital, and curated products. Product availability, pricing, production times, and purchase limits may vary.

Because many products are handmade or assembled in small quantities, slight variations in color, placement, pattern, texture, dimensions, or finishing may occur. These natural variations are part of the handmade process and do not necessarily indicate a defect.

We make reasonable efforts to display product colors and images accurately. However, colors may appear differently depending on the customer’s device, screen settings, lighting, and other factors.

We reserve the right to modify or discontinue products or services, limit quantities, and correct descriptions or pricing at any time. An item placed in a shopping cart is not reserved until checkout and payment are completed.

SECTION 3 — CUSTOM AND PERSONALIZED ORDERS

Customers are responsible for entering names, dates, wording, colors, quantities, shipping information, and other personalization details accurately.

Please review all information carefully before submitting an order. We are not responsible for errors provided or approved by the customer.

When a proof or design approval is requested, production may not begin until approval is received. Delays in responding may extend the estimated completion date.

Custom, personalized, and made-to-order products are created specifically for the customer and are generally not eligible for return or exchange. This restriction does not apply when an item arrives damaged or defective or when Classy Butterfly makes an error.

Production times depend on the product, quantity, design requirements, material availability, and customer response time. Current processing information is provided in our Shipping Policy or communicated during the custom-order process.

SECTION 4 — BULK AND ORGANIZATIONAL ORDERS

Bulk, event, church, nonprofit, school, conference, corporate, and other organizational orders may require a separate quote, invoice, deposit, production schedule, design approval, or written agreement.

When a separate written agreement applies to an order, that agreement controls if it conflicts with these general Terms.

Quoted prices and production availability are not guaranteed until the required payment or deposit is received and the order is confirmed.

SECTION 5 — DIGITAL PRODUCTS AND CREATIVE CONTENT

Digital downloads, templates, measurements, instructions, cut files, tutorials, videos, photographs, graphics, designs, and other creative materials remain the intellectual property of Classy Butterfly or their respective rights holders.

Unless a product listing provides a different license, purchasing or accessing digital content grants the customer a limited, nonexclusive, nontransferable license for personal use only.

Customers may not reproduce, resell, redistribute, share, upload, publish, sublicense, or commercially exploit our digital products or creative content without prior written permission.

Digital products are generally nonreturnable and nonrefundable after access or download unless required by law or the file is defective and cannot reasonably be replaced.

SECTION 6 — PRICES, PAYMENTS, AND TAXES

Prices are listed in U.S. dollars unless otherwise stated and may change without notice.

Applicable taxes, shipping charges, and other fees are displayed during checkout when required. Customers are responsible for providing current, complete, and accurate billing and payment information.

Submitting an order does not guarantee acceptance. We reserve the right to cancel or limit an order because of suspected fraud, payment problems, inventory errors, incorrect pricing, production limitations, prohibited resale activity, or other reasonable business concerns.

If we cancel a paid order, we will issue an appropriate refund to the original payment method.

SECTION 7 — ORDER CHANGES AND CANCELLATIONS

Contact us as soon as possible if you need to request an order change or cancellation. We cannot guarantee changes or cancellations after payment, production, personalization, packing, or shipping has begun.

Custom and personalized orders may not be canceled after materials have been committed or production has started. Any approved cancellation may be reduced by nonrecoverable material, design, or production costs when disclosed and permitted by law.

SECTION 8 — SHIPPING AND LOCAL DELIVERY

Processing times, shipping services, free-shipping qualifications, local-delivery requirements, address responsibilities, and carrier-delay information are governed by our Shipping Policy.

Carrier delivery dates are estimates and are not guaranteed by Classy Butterfly. We are not responsible for delays caused by carriers, severe weather, holidays, service interruptions, emergencies, incorrect addresses, or circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate delivery address. Contact us promptly if a correction is needed. We cannot guarantee that an address can be changed after processing or shipment begins.

SECTION 9 — RETURNS AND REFUNDS

Returns, nonreturnable items, damaged or defective products, return-shipping responsibility, exchanges, and refund timing are governed by our Return and Refund Policy.

Customers must receive authorization and return instructions before mailing an item. Items returned without prior authorization may not be accepted.

SECTION 10 — ACCOUNTS AND CUSTOMER INFORMATION

If you create an account, you are responsible for maintaining the confidentiality of your login information and for activity conducted through your account.

You agree to provide accurate and current account, contact, billing, and shipping information. Notify us promptly if you believe your account has been accessed without authorization.

SECTION 11 — INTELLECTUAL PROPERTY

The website and its content—including text, photographs, videos, product designs, graphics, logos, downloads, tutorials, and other materials—are owned by or licensed to Classy Butterfly and are protected by applicable intellectual-property laws.

You may view and use the website for personal, noncommercial shopping and informational purposes. You may not copy, reproduce, modify, distribute, sell, exploit, or create derivative works from our content without prior written permission.

References to third-party names, trademarks, products, or services remain the property of their respective owners.

SECTION 12 — REVIEWS, FEEDBACK, AND SUBMISSIONS

If you submit a product review, testimonial, photograph, comment, suggestion, or other content, you confirm that you have the right to submit it and that it does not violate another person’s intellectual-property, privacy, publicity, or other rights.

You grant Classy Butterfly a nonexclusive, royalty-free license to use, reproduce, edit, and display voluntarily submitted reviews, testimonials, and related content for operating and promoting the business, subject to applicable law.

We may remove submissions that are unlawful, fraudulent, abusive, misleading, infringing, obscene, or otherwise inappropriate.

Do not submit confidential business ideas, proprietary designs, or sensitive personal information through reviews or public comments.

SECTION 13 — THIRD-PARTY SERVICES AND LINKS

The website may contain links to or integrations with Shopify, payment providers, social media platforms, shipping carriers, applications, or other third-party services.

We do not control every third-party service and are not responsible for its content, availability, privacy practices, security, products, or terms. Your use of a third-party service is subject to that provider’s policies and terms.

SECTION 14 — PRIVACY

Our collection, use, and disclosure of personal information are governed by our Privacy Policy.

Because our store is hosted by Shopify, information provided through the website may be processed by Shopify and relevant service providers to operate the store, complete transactions, prevent fraud, improve services, and provide other ecommerce functionality.

SECTION 15 — ERRORS AND CORRECTIONS

Occasionally, the website may contain typographical errors, inaccuracies, or omissions involving product descriptions, pricing, promotions, availability, shipping charges, processing times, or other information.

We reserve the right to correct errors, update information, or cancel affected orders when reasonably necessary, including after an order has been submitted. If a paid order is canceled because of our error, we will issue an appropriate refund.

SECTION 16 — PROHIBITED USES

You may not use the website or its content to:

• Violate applicable laws or regulations
• Infringe intellectual-property or privacy rights
• Submit false, fraudulent, or misleading information
• Harass, threaten, abuse, defame, or discriminate against another person

Where liability cannot legally be excluded, our liability will be limited to the maximum extent permitted by applicable law. These limitations do not restrict rights or remedies that cannot be waived under applicable consumer-protection law.

SECTION 19 — INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless Classy Butterfly LLC and its owners, employees, contractors, and service providers from third-party claims arising from your unlawful use of the website, violation of these Terms, or infringement of another person’s rights.

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the fullest extent permitted or removed as necessary. The remaining provisions will remain in effect.

SECTION 21 — TERMINATION

These Terms remain effective while you use the website or services.

We may suspend or terminate access when we reasonably believe a user has violated these Terms, engaged in fraud or abuse, created a security risk, or used the website unlawfully. Obligations and liabilities arising before termination will survive where appropriate.

SECTION 22 — ENTIRE AGREEMENT

These Terms and the policies referenced within them constitute the agreement between you and Classy Butterfly concerning use of the website and online store, except when a separate written agreement applies to a custom, bulk, organizational, or other special order.

Our failure to enforce a provision does not waive our right to enforce it later.

SECTION 23 — GOVERNING LAW

These Terms and any related transactions are governed by the laws of the State of Oklahoma and applicable federal laws of the United States, without regard to conflict-of-law principles.

Nothing in this section limits consumer rights that apply under mandatory law.

We may revise these Terms to reflect changes in our products, services, business practices, technology, or legal obligations.

The revised Terms will be posted on this page with an updated effective date. Continued use of the website after changes are posted constitutes acceptance of the revised Terms to the extent permitted by law.
